Welcome to LCPtracker’s Spark (“Spark”) seminar. We are excited to have you join us at The Fontaine Hotel from June 6th to June 7th, 2024! Here you (“you” or “Registrant“) will find complete details on LCPtracker’s registration, attendance, and speaker policies. If you have any questions, please contact [email protected]. As a Registrant, you also agree to these Terms on behalf of any accompanying parties.

The Terms set out the terms and conditions between LCPtracker and you when you register for Spark. By registering for Spark, you are agreeing to comply with these Spark Terms. You should read this document carefully. Prior to your registration, you must acknowledge and accept the Spark Terms contained herein. Should you not wish to accept the Spark Terms you should not register. Submission of a registration is regarded as affirmation of your acceptance of these Spark Terms.

REGISTRATION RATES

Once you complete the purchase of your registration, the rate is considered final and will not be adjusted. Registration cancellations received via email request to [email protected] prior to 5:00 PM (PDT) on Tuesday, April 30th,th, 2024, will be refunded. Cancellation requests received after this date will be refunded according to the schedule below. CANCELLATION REQUESTS RECEIVED WITHIN 72 HOURS BEFORE THE START OF SPARK WILL NOT BE REFUNDED.

CANCELLATION

LCPtracker has the right to cancel Spark for any reason and will refund your registration but will not be responsible for any consequential damages that may be incurred by Registrant.

LCPtracker reserves the right to make changes in programs, speakers, or venues or to cancel or postpone certain programs if enrollment criteria are not met or when conditions beyond its control prevail.

LCPtracker reserves the right to cancel registrations in order to meet capacity requirements if at the time of the conference capacity requirements are imposed by the hotel and/or local or state authorities.

REGISTRANT HEALTH PROMISE

You acknowledge and understand that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), you and/or any accompanying parties may infect others that they may subsequently come in contact with, even if you are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, the Registrant agrees that neither the Registrant nor any accompanying party will attend Spark if within ten (10) days preceding Spark, they have: (1) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease, OR (2) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease, OR (3) been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease. A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other communicable and/or infectious diseases, viruses, bacteria, or illnesses or the causes thereof.

If you are unable to attend Spark due to the reasons outlined above, your pre-paid registration fee can be applied toward a future LCPtracker event or the value of your registration can be applied towards LCPtracker Academy certification program(s). You can email [email protected] to request this transfer.

WARNING – ASSUMPTION OF RISK

COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. BY REGISTERING FOR SPARK, YOU, ON YOUR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES, AGREE TO (1) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL RELATED HEALTH AND SAFETY POLICIES OF FOUR POINTS BY SHERATON SACRAMENTO INTERNATIONAL AIRPORT HOTEL AND LCPTRACKER AND ALL OTHER TERMS AND CONDITIONS SET FORTH IN THESE SPARK TERMS. A COPY OF THE SPARK CONDITIONS OF ADMISSION CAN BE ACCESSED AT WWW.LCPTRACKER.COM/SPARK-TERMS-CONDITIONS.

HEALTH RESTRICTIONS

LCPtracker has the right to impose health restrictions and mandates on Registrants and those who attend Spark to protect the health and safety of our Registrants and staff members. If Registrants or accompanying parties are non-compliant with these restrictions and/or mandates, LCPtracker has the right to refuse admittance and/or expel them from Spark.

PAYMENT

We accept Visa, MasterCard, American Express, Discover, and check (invoice) payments. Invoice payments are due upon receipt. If payment is not received by 5/18/24 5:00 PM PDT, registrations may be cancelled. Please contact [email protected] for any questions regarding payment.

SUBSTITUTIONS

If you know you cannot attend Spark, you can transfer your Event Pass to someone else for free until 5:00 PM PDT on June 5th, 2024. To transfer your pass, send a request via email to [email protected] by June 5th, 2024.

FAILURE TO PERFORM

LCPtracker shall not be liable for any failure to perform or any delay in performing its obligations if the failure or delay is due directly or indirectly to any cause beyond the reasonable control of the organization, its employees, agents or representatives which shall include, but is not limited to, the following Acts of God: fire, flood, explosion, accident, pandemic, civil disturbance or emergency or periods of armed conflict.

OPT-IN

By registering for Spark, LCPtracker may also use your information to market, advertise, promote, or otherwise contact you about our products and services. If you do not want us to use your information in this way, please email [email protected].

YOUR DATA

LCPtracker is committed to data privacy and protecting your personal information. Information on how we collect, process, and use your data is included in the LCPtracker Privacy Policy which is incorporated into these Terms & Conditions. Additionally, by submitting your email details during this Spark registration process, you agree that LCPtracker may send you Spark-related information. A valid email address is required for all registrations. LCPtracker uses the personal data you provide in this registration for administering your participation in Spark.

Spark co-sponsors, exhibitors, and other third parties may directly request your personal information at their exhibit tables, presentations or elsewhere. If you are approached, please remember that this sharing is optional, and you should review their privacy policies to see how they will treat your personal information. LCPtracker takes no responsibility for how any of the aforementioned entities use your personal information.

PHOTOGRAPHY, AUDIO, AND VIDEO RECORDING

Spark is held in a public space. We don’t prohibit Registrants, sponsors, news organizations, and other companies from photographing, capturing video, or audio taping activities. You are permitted to use hand-held cameras and/or smart phones to take photographs and capture digital images for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, reproduced, transmitted, distributed or otherwise commercially exploited in any manner whatsoever. We reserve the right to use all images, videos, and audio files taken at Spark that include participants, including yourself. By attending Spark, you consent to having your image, voice, likeness, and/or presentation recorded. We reserve the right to use such images, recordings, and videos without notice or compensation. Such recordings might include content or material that is protected by copyrights, trademarks, or other rights in which LCPtracker owns or licenses. Registrants are not allowed to copy, reproduce, publish, or distribute any photographs, videos, or audio files taken at Spark for commercial use without express prior written permission from LCPtracker.

We may hire professional service providers (photo/video/streaming/audio) to document and display the Spark experience. We may also use social media (e.g. Twitter) to: (i) post real-time photos and videos to our social media feeds; and (ii) display select submissions from those feeds on monitors throughout the venue. Registrants and sponsors are encouraged to capture their Spark experiences and post their own brief social content from Spark  (text, photos, audio, video, streaming), provided it does not infringe upon the rights of any Registrant, accompanying party, sponsor, third party, or LCPtracker. Such infringement would include, but is not limited to, defamation or infringement of intellectual property rights. In the event you require a release or permission to protect the rights of a third party, obtaining such a release or permission shall be your sole responsibility.

By attending Spark, you acknowledge and agree as follows: (a) LCPtracker may edit and use footage it captures at Spark for marketing and promotional activities and for any other lawful purpose in the ordinary course of its business; and (b) due to the prevalence of mobile recording devices in today’s world, LCPtracker disclaims all liability for the capture of your image in any multimedia format by other attendees at Spark. LCPtracker has the right to include photos and videos of Registrants, accompanying parties, speakers, and sponsors for marketing and publicity without compensation.

MINIMUM AGE REQUIREMENT

Attendees must be 18 years of age or older to attend the conference and any official related activities.

LIABILITY WAIVER AND RELEASE

In consideration of being allowed to register for, and participate in Spark, you hereby warrant and represent that you are age 18 or above and freely waive, release from liability, assume all risks, and covenant not to sue LCPtracker or its members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, illness, including but not limited to COVID-19, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after Spark, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of LCPtracker. This Liability Waiver and Release is specifically binding upon your heirs and assigns and is knowingly given.

OFFENSIVE BEHAVIOR/NO COMMERCIAL SOLICITATION BY NON-SPONSORS

At LCPtracker, we want everyone to enjoy the conference without being subject to any offensive or inappropriate behavior. As such, LCPtracker reserves the right, in its sole discretion and without refund, to refuse admittance to or to expel anyone from the conference whom we determine is behaving or is likely to behave in a manner detrimental to Spark or to any attendee. We further reserve the right to expel any individual non-sponsor/exhibitor from Spark if they are reported to be commercially soliciting other attendees at Spark. Registrants should report any behavior inconsistent with these principles to onsite LCPtracker staff. LCPtracker staff will be happy to help Registrants contact venue security or local law enforcement, provide escorts, or otherwise assist those experiencing harassment to feel safe for the duration of Spark. We value your attendance and are committed to providing a safe, productive, and welcoming environment to all Registrants, accompanying parties, support staff and vendors/exhibitors.

UPDATES/REVISIONS TO THESE SPARK TERMS

Please be aware that LCPtracker may update and/or revise these Spark Terms, or any part thereof, at any time. If LCPtracker updates or revises these Spark Terms, the updated/revised Spark Terms will be posted on www.lcptracker.com/spark-terms-conditions.

In the event that LCPtracker updates the Spark Terms, the “Last Modified” date on the site will be updated to reflect the date of the most recent version. We encourage you to review these Spark Terms periodically. If you do not agree with these Spark Terms, do not register for Spark.

Presenters alone are responsible for the content of their respective program, presentations and/or handouts, which are offered for informational purposes only. The views and opinions expressed in the sessions are not necessarily those of LCPtracker and are not endorsed by LCPtracker. LCPtracker disclaims any and all legal liability or responsibility for the content expressed in the sessions or materials distributed as a part of the session.
